October 2025 - Ashley Mattress Update
ELG would like to provide you with this month's update on the Ashley and Nectar mattress litigation.
As we previously shared, settlement negotiations with Ashley and Nectar stalled, and we were left with no choice but to file a class action complaint in federal court in Wisconsin on August 30, 2024. The case is moving forward, and the discovery process is underway. While discovery can be lengthy, we are encouraged by the progress to date.

June 2024 - Ashley Update
We recently learned that the Ashley mattress company bought the Nectar mattress company. As you might imagine, this has caused delays in our ability to progress with negotiations. Ashley and Nectar were represented by different law firms in our separate negotiations, and now the companies are in the process of combining their operations and legal representation. We are working through the various issues raised by this merger.
April 2024 - Ashley Mattress Update
Report on first round of mediation
As mentioned last month, we have entered into mediation with Ashley to attempt to resolve claims without litigation. Mediation in cases such as this often takes several rounds of negotiation to determine whether it will succeed. After the first round, no resolution was reached, but we learned more about Ashley Mattress’s position, which will inform our negotiations moving forward. Thank you for your patience as we engage in this process.
March 2024 - Ashley Mattress Update
Thank you for your continued trust in ELG to represent you in the Ashley mattress dispute arising from fiberglass exposure. Our lawyers and staff continue to work hard to protect your rights and obtain the compensation you deserve.
After initiating conversations with Ashley Furniture, we agreed to enter into an alternative dispute resolution process known as mediation. In mediation, a neutral third party, known as a mediator, assists the parties in determining whether a settlement structure and amount can be agreed upon to resolve the disputes between the parties.
In this particular case, Ashley has indicated that they are only interested in a global resolution, meaning they are not willing to settle individual claims in piecemeal fashion. Consequently, we are negotiating with them on behalf of all of our clients in an attempt to work out a global solution that will allow everyone with valid claims to be fairly compensated. In matters such as this impacting thousands of people, mediation often takes multiple rounds. If our mediation with Ashley is successful, you will be notified of the details and have the opportunity to consent to the terms of your settlement offer.
On the other hand, if mediation is not successful, we plan to proceed with litigation in court, which as you might imagine, is an even longer process, but often a necessary one.
