January 2026 - Zinus Update

We are pleased to inform you that the reconciliation process with Zinus is complete. We appreciate your patience during this time. The next step in finalizing the settlement will be a court hearing to approve some settlements for the minors who are named plaintiffs in the lawsuits. This is a very small group of clients but is required under the terms of the settlement. Our legal team is working to schedule this hearing as soon as possible.

Once the hearing is complete, payment from Zinus is due soon after. This money must be held in a trust account until such time it can be released to clients. Please be advised that processing payments can take some time and we still have to clear some required procedural matters such as subrogation of Medicare payments. Our goal is always to release settlement funds to clients as quickly as possible.

Additionally, if you previously applied for the Special Payment Fund ("SPF"), your payment will be delayed while your application is considered by an independent third party. Our office will be in contact with everyone who applied to the SPF with legal advice and further information.

As always, it is extremely important that you quickly respond to any outreach from our office other than general updates. We will provide further updates as soon as additional information becomes available.

November 2025 - Zinus Update

Your legal team continues the reconciliation process with the attorneys for Zinus. While this has been a lengthy process, it is necessary to ensure every executed release is properly included and we receive the maximum value for each of our clients. We are optimistic the reconciliation process will be completed in coming weeks and the settlement will be finalized.

It is extremely important that you quickly respond to any outreaches from our office. Zinus has raised some issues with some executed releases if certain information is missing. We have an opportunity to correct these deficiencies during the reconciliation process. Once the reconciliation is complete, our office will being working with clients who desired to be considered for the Special Payment Fund.

September 2025 - Zinus Update

The final deadline has now passed. While some required benchmarks fell short, your attorneys remain optimistic that Zinus intends to move forward with final resolution. July 2025 - Zinus Update

We hope this message finds you well. Below is an important update from your attorneys at ELG regarding the Zinus settlement process.

As you know, the final deadline to return executed releases passed on July 21, 2025. We are now entering the next stage - a three-week reconciliation period with the defendants to determine the final settlement values. This process includes verifying submissions, cross-checking data, and calculating final allocations.

While this deadline was considered final, it is still possible that an additional extension may occur. However, we remain hopeful the settlement will be finalized within the next 30 days. If you have not yet submitted your release, we encourage you to send it in immediately via email to zinusdocs@elglaw.com. Our team will attempt to include any late submissions, although we cannot guarantee acceptance.

For those of you who applied to the Special Payment Fund, please note that our attorneys are actively reviewing all submissions. We will be in contact with you soon to provide our legal opinion on whether your claim may qualify for additional compensation. Please keep in mind that final determinations will be made by a third-party Special Master, who is not affiliated with our firm.

June 2025 - Zinus Update

We continue to work tirelessly to collect necessary signatures to finalize the settlement agreement. Thank you to the clients that have submitted the executed releases. However, we still lack signatures from a group of clients.

The settlement cannot be finalized until we receive releases back from the majority of clients. Failure to return a majority of the executed releases may result in termination of the entire settlement agreement. Additionally, the total monetary settlement may be reduced if certain benchmarks are not met.

Your attorneys at ELG recently met with Zinus' counsel and secured another extension until July 7, 2025. It is very likely that this will be the final extension agreed to by Zinus. Our office is putting all available resources into collecting the outstanding releases to benefit all of our clients.

You should be advised that payment will not be made immediately after the deadline. We still must complete a reconciliation process with Zinus and undergo mandatory government reporting for potential Medicare subrogation issues. This can be a lengthy process, but we are committed to releasing the funds to our clients as soon as possible.

Application to the special payment fund still remains open. Please email zinusspf@elglaw.com if you would like to apply. This fund is reserved only for clients with extraordinary injuries. If you apply for the fund and ultimately do not qualify, your settlement amount will be reduced and your timeframe for receiving settlement funds will be much longer. Our office has worked diligently over the past several months to obtain executed releases from all clients. Thousands of clients have submitted the executed releases, and we are thankful for your quick response. Unfortunately, a group of clients have been nonresponsive or otherwise failed to submit the release.

If you recall, the settlement cannot be finalized until we receive releases back from the majority of clients. July 2024 - Zinus Mattress Update

We write to update you on the status of the Zinus Master Settlement Agreement. We appreciate your continued patience and understand this has been a lengthy process.

Since the initial agreement in principle on resolution, our legal team have conducted dozens of meetings with defense counsel to finalize the terms of the settlement agreement. Many issues have been hotly contested, and we have worked diligently to secure the best possible settlement agreement for your claim. It remains our goal to get every dollar we can to compensate you for your injuries.


Very recently we reached an agreement with defense counsel on the settlement agreement language. Counsel for Zinus must now obtain final approval from numerous insurance companies in order to finalize and fund the settlement agreement. This is likely to take additional time, but our team will continue to work to finalize the settlement agreement as soon as possible.


This is very common in this type of litigation, as the language of the settlement agreement is complex and can greatly affect your rights.
