The Victim Compensation Fund bases its compensation calculations for non-economic loss on these factors:

  • the severity of the health condition
  • the type of health condition, illness, or cancer
  • the ways that the health condition has impacted the responder or survivor's life

Usually, receiving another 9/11 diagnosis will not change the amount of a Victim Compensation Fund award that was previously issued. However, if the new condition is cancer and the award was only based on a benign condition, you should consider amending your claim. The Victim Compensation Fund might also increase the award if your certified condition worsens. It is worth noting that filing an amendment to add a non-cancer condition will not change an award amount in most cases unless the condition is recognized as one that is "presumptively severe and debilitating."
